These Terms of Service ("Terms") govern your access to and use of the Body Observability website and related online services (collectively, the "Services"). By using the Services, you agree to these Terms.

1. Acceptance of these Terms

If you do not agree to these Terms, do not use the Services.

2. Changes to these Terms

We may update these Terms from time to time. Your continued use of the Services after an update constitutes acceptance of the updated Terms.

3. Eligibility

You must be at least 18 years old to use the Services.

4. What we provide

Body Observability is a membership designed to support Longitudinal Healthspan Intelligence—helping members observe change over time through consistent measurement and structured reporting.

5. Not medical care; no diagnosis or treatment

Body Observability does not provide medical care, diagnosis, or treatment. Outputs and reports are for informational purposes only and are not a substitute for professional judgment.

6. Waitlist

Joining the waitlist does not guarantee membership availability, studio access, or pricing.

7. Membership purchases; renewals; billing

• Pricing: Membership is presented as $699/year unless otherwise indicated at checkout.
• Renewal: Memberships may renew automatically unless you cancel prior to renewal.
• Cancellation: Cancellation stops future renewals; it may not entitle you to a refund for the current term unless required by law or expressly stated in writing.

8. Studio access; scheduling; measurement spacing

Studio access and measurement availability may be subject to appointment availability, capacity, safety considerations, and spacing between certain measurement categories. Blood panels are included up to three (3) times per year unless otherwise stated.

9. Communications

By using the Services, you consent to receive operational communications electronically (email/SMS), including scheduling and service updates.

10. Privacy and security

Our collection and use of information is described in our Privacy Policy. We maintain safeguards designed to protect member information and do not sell member information.

11. Acceptable use

You agree not to misuse the Services, attempt unauthorized access, interfere with operation, or use the Services for unlawful purposes.

12. Intellectual property

The Services and all associated content are owned by Body Observability or its licensors.

13. Disclaimers

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES.

14. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BODY OBSERVABILITY WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.

15. Dispute resolution; arbitration; class action waiver

Disputes may be resolved through binding arbitration rather than in court, except where prohibited by law. Claims must be brought in an individual capacity and not as part of a class action.

16. Governing law

These Terms are governed by the laws of the State of New York, without regard to conflict of law principles, except where federal law applies.
